Last Exit Before Procrastination Terms

Version: 2026-10-11-platform-1

Effective Date: When this version is published on Pumpit.app

Operator: Luka AI, Inc.

Brand: Pumpit.app

1. Scope and agreement

These Terms govern Pumpit.app and Pumpit-hosted products. “Luka,” “we,” and “us” mean Luka AI, Inc., a Delaware corporation at 8 The Green, Ste R, Dover, DE 19901, United States. Pumpit.app is Luka's customer-facing platform. By selecting an action accompanied by a notice referring to these Terms, you agree to these Terms. The Privacy Notice explains data handling; agreeing to these Terms is not consent to every use of personal information.

You must be at least eighteen (18) years old to create an account or use Pumpit's creator or customer services. You must have authority to act for any business you represent. Additional legally required eligibility or verification requirements may apply to a particular service.

Creator-specific licenses, revenue sharing, responsibilities and termination are governed by the Creator Partnership Agreement, expressly accepted in the creator dashboard. A brief, checkout, payment-account connection, or admin action does not replace that acceptance. For creator-specific matters, that Agreement controls over these Terms.

2. Platform and products

Pumpit provides hosted digital products, assessments, AI-supported interactions, educational materials, memberships, subscriptions, reporting and related services. A creator's participation does not make that creator the operator of the platform. We use reasonable efforts to operate the service and address service problems; we do not promise uninterrupted or error-free operation.

3. Accounts and acceptable use

Provide accurate information, protect your account credentials and use the service lawfully. Do not access another person's account or private data, bypass payment or access restrictions, interfere with security, submit material you are not authorized to provide, violate intellectual-property or privacy rights, or use the service to harm others. We may restrict affected access while reasonably investigating fraud, unlawful conduct, serious breach or safety/security risks, subject to applicable law.

4. Content and ownership

Luka owns its software, infrastructure, templates, generic systems and platform improvements. Users retain rights they have in their submissions and grant Luka the limited rights reasonably needed to provide, secure and support the relevant service. Shared platform learning is limited to aggregate or de-identified information, subject to the Privacy Notice and applicable law. This does not transfer ownership of personal information or waive privacy rights.

Creator materials and identity remain subject to the Creator Partnership Agreement. Before that Agreement is accepted, creator-brief information may be used for direct communication with that creator, internal analysis and platform improvement as described in the Privacy Notice, but not as licensed material in a Pumpit product. Providing a brief does not create a creator-product license or exclusivity.

5. AI and safety

AI responses may be incomplete or incorrect. Products are not a substitute for licensed medical, legal, financial, emergency or other professional advice. Use appropriate professional help when needed. You remain responsible for your decisions. An AI response is not necessarily a creator's real-time or verbatim personal communication. Luka may moderate, restrict, pause or remove affected content or features for safety, legal or operational reasons, subject to applicable law.

6. Fees, purchases and continuity

Applicable prices, billing frequency, renewal, cancellation and any free-period end or paid continuation are shown before purchase or authorization. Luka may set or change platform fees with advance notice and any consent required by law. A discount or saved payment method does not authorize an undisclosed new charge. Fees are separate from any creator revenue-sharing calculation.

Refunds, chargebacks, credits and cancellations follow the displayed purchase terms and applicable law. Mandatory consumer remedies are not waived. If a creator relationship ends, Luka may remove creator-specific identity/materials, rebrand a product and serve existing paid customers for their paid period, while applying applicable customer remedies. Creator license and removal rights are governed by the Creator Partnership Agreement, not by a customer's purchase.

7. Data and privacy

The Privacy Notice explains account information, briefs, assessments, conversations, uploads, payment/payout information, analytics and acceptance records. Creators receive aggregate product reporting by default, not raw customer conversations, assessments or identifiable user data. User-level creator access requires a separate Luka-controlled authorization defining scope, recipient and duration. Where a purpose requires consent, we request it separately and provide a way to withdraw it.

8. Separate programs and features

Campaigns and optional features have their own terms and acceptance where presented. The Product Referral Program Terms govern that program only. Founding-creator discount terms govern only an eligible offer accepted by its recipient. Feature-specific authorizations govern only the enabled feature. Each separate agreement controls its stated subject and does not silently change unrelated rights, the Creator Agreement's base revenue share, or another program's accepted terms.

Invited Connectors and other business counterparties participate under their own agreements. Ordinary customer use does not create a Connector or other commission relationship, product ownership, editing rights or access to another person's private records.

9. Intellectual-property complaints

Contact support@pumpit.app with sufficient information to identify a claimed infringement and your authority to raise it. Luka may restrict disputed material while reviewing the complaint and may request information reasonably necessary to resolve it.

10. Disclaimer and limitation

To the extent permitted by law, the service is provided on an as-available basis without guarantees of sales, revenue, conversion, accuracy or personal outcomes. Luka is not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or lost profits, revenue, goodwill or data. Luka's total liability under these Terms will not exceed the amount the claimant paid Luka for the applicable service during the twelve months before the event giving rise to the claim. These limits do not exclude mandatory consumer remedies, liability that cannot legally be limited or excluded, or payment obligations for earned amounts. The Creator Partnership Agreement's specific monetary limit governs the creator relationship instead of this general limit.

11. Governing law and venue

Delaware law governs these Terms without regard to conflict-of-law rules. State or federal courts in Delaware have exclusive jurisdiction, except where mandatory consumer or other applicable law requires otherwise. Applicable mandatory protections are not waived.

12. Notices and changes

Contact support@pumpit.app. Luka may update these Terms by publishing a new version and giving notice required by law. Material changes requiring acceptance will be presented for acceptance; any longer mandatory notice period applies. Changes do not retroactively reduce amounts already earned or silently change a separately accepted agreement's subject-specific terms.
